Terms of Service
1. Eligibility and acceptance
You must be legally permitted to use HDify and capable of entering into these Terms. If you use HDify for an organization, you represent that you have authority to bind that organization. If you do not agree to these Terms, do not use HDify.
2. The service
HDify provides on-device tools to enhance photos, remove selected objects, and remove backgrounds. Results depend on the source image, device capabilities, model limitations, and your selections. We may improve, add, limit, or discontinue features, subject to applicable law.
3. Your photos and results
You retain your rights in photos you select and results you create. HDify processes photo content locally and does not require you to upload photo content to us. You are responsible for having the rights and permissions necessary to edit, save, or share an image and for how you use the result.
You must not use HDify to violate privacy, publicity, copyright, trademark, or other rights, to mislead others unlawfully, or to create or distribute unlawful or harmful material.
4. License
Subject to these Terms and applicable App Store rules, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use HDify on Apple devices you own or control for lawful purposes.
5. Prohibited conduct
You may not:
- use HDify in violation of law or another person’s rights;
- attempt to bypass security, usage limits, or access controls;
- interfere with or overload HDify or its related services;
- use automated means to probe or abuse our services;
- reverse engineer or extract protected source code or models except where applicable law expressly permits it; or
- remove copyright, trademark, or proprietary notices.
6. Intellectual property
HDify, including its software, models, visual design, branding, and documentation, is owned by or licensed to us and is protected by applicable intellectual-property laws. These Terms do not transfer ownership of HDify or our intellectual property to you.
7. Updates and availability
Updates are distributed through Apple and may be required for continued compatibility or security. HDify may not be available in every country, on every device, or at all times. Removing the app stops your use of HDify but does not reverse actions you previously took, such as sharing a saved result.
8. Third-party services
HDify uses Apple system services such as the App Store, Photos, Files, and the share sheet. Your use of those services is governed by Apple’s terms and settings. Links to external sites are provided for convenience; we do not control their content or availability.
9. Disclaimers
To the maximum extent permitted by law, HDify is provided “as is” and “as available.” We do not guarantee that every result will be accurate, suitable for a particular purpose, uninterrupted, or error-free. You should keep original copies of important images and review results before relying on or sharing them. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, opportunity, goodwill, or data, arising from HDify. Any limitation applies only to the extent allowed in your jurisdiction and does not limit mandatory consumer rights.
11. Suspension and termination
You may stop using HDify at any time by deleting it. We may suspend access to related online services where reasonably necessary for security, legal compliance, abuse prevention, or a material breach of these Terms. Provisions that by their nature should survive termination will continue to apply.
12. Changes to these Terms
We may update these Terms. We will publish a new dated version and provide additional notice when required by law. Continued use after an update takes effect constitutes acceptance where permitted by law. Previous dated versions remain available at their original URLs.
13. Governing rules
These Terms are governed by applicable law, without limiting mandatory consumer protections available where you live. If any provision is unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver.
14. Apple terms
These Terms are between you and us, not Apple. Apple is not responsible for HDify or its support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. If HDify fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as provided by App Store terms; to the maximum extent permitted by law, Apple has no other warranty obligation for HDify.
Apple is not responsible for claims relating to HDify, including product-liability, regulatory, consumer-protection, or intellectual-property claims. You represent that you are not located in a country subject to a U.S. Government embargo or designated as supporting terrorism and are not listed on a U.S. Government restricted-party list.
